The following provisions set out the general terms and conditions applicable to the site platform.
  1 - Definitions

  • "Account" means exclusively private space that GAMBLING AFFILIATION provides to the advertiser so he can manage the proper progress of its advertising campaigns.
  • "Visual Advertising" means all the visual advertisements used to promote the site of the advertiser: linked texts, banners, ads ...
  • "CPM" (Cost Per Thousand) means the posting of one thousand visual advertisements on the platform.
  • "CPC" (Cost Per Click) means action by a Net surfer who clicks on one of the advertising banners appearing on the platform.
  • "CPA" (Cost Per Acquisition) means an action carried out on the site of the advertiser, after the click by the net surfer:registration, visit to a special page, sale, etc.
  • "Revenue Share" (Percentage on the players losses) indicates action by a net surfer to make a purchase on the site of the advertiser, the CPA being compensated by a commission on such sales.
  •   2 - Advertising campaigns management
    GAMBLING AFFILIATION shall make available to prospective advertisers a sophisticated interface making it possible to propose to affiliates various advertising campaigns. This interface also makes it possible for the advertisers to observe the results of their campaigns by means of readable statistics in the form of drop-down menus. The advertiser is also able to personalize its relationship with each editor by modifying the public sales price indicated at the beginning of the campaign and by permitting the suspension of editors in the event of poor performance results.
    At the time of the going on line with a new campaign, the advertiser can propose itself the amount of compensation allocated to the editor as well as the conditions of payment: on posting, at the time of the click, on the filling out of a form or the time of sale. It will also prepare and install a short text intended to promote interest by editors with reGard to the campaign.
    Once the campaign has activated by us, the advertiser will have to go on the interface with the editors in order to validate the site partners which it wants to use for the campaign. The account of the advertiser will be automatically debited at the time of each recorded movement on one of the partners' sites under the conditions determined at the time of the creation of the campaign. When the account of the advertiser approaches zero, advertiser will be asked to further credit its account. Otherwise, we reserve the right to suspend the campaign at any time with 48 hours notice.. The total cancellation of a campaign may be decided pursuant to the provisions of Article 9 below.

    GAMBLING AFFILIATION undertakes to make available for the advertiser all necessary technical and human resources for the success of the advertiser's advertising campaign:

    - By providing statistics and daily detailed reports on the advertiser's advertising campaign.
    - By providing free advisory services to the advertiser on opportunities and strategies relating to the campaign via the form found on the administrative portion of advertiser's campaign.
    - By offering a list of affiliated sites allowing the advertiser to promote its site or its trademark.
    In order to carry out under the best possible conditions your campaign, we can place at your disposal a person who will take responsibility for fully managing the campaign. In this regard, the "Affiliate Manager" will set up your campaign on the relevant media support and will completely manage it according to your requirements. This type of service is invoiced 1,000 euros per month of management, and a specific contract will apply..
      3 - Guarantees
     GAMBLING AFFILIATION does not guarantee the absence of technical risks or temporary interruption. In the event of any problem of this nature GAMBLING AFFILIATION could not be the subject of complaints or pursuits.
    GAMBLING AFFILIATION does not guarantee to the advertiser a minimum volume of sale or more generally a certain degree of success, concerning the campaigns present on the platform.
    Gambling Affiliation will not be held responsible of the fact that the sites validated by the advertiser do not respect the specifications or his expectations in advertising.
    GAMBLING AFFILIATION could not be held responsible in case an advertising would appear twice due to a competitor platform.
    GAMBLING AFFILIATION could not be been liable in the case a litiGation between the advertiser and the editor would suddenly appeared. Nevertheless GAMBLING AFFILIATION will be committed with all implementing in order to moderate the different one and to find an amicable solution.
      4 - Advertiser commitments
     The advertiser undertakes not to use any automated systems or agents, scripts or robots for the purpose of accessing any services offered by GAMBLING AFFILIATION.

    The advertiser shall not communicate to a third party the contents of GAMBLING AFFILIATION's internet site. Access to the advertiser's account is granted soley for the purse of permitting the consultation, the follow-up and the management of its advertising campaigns.

    The advertiser undertakes to furnish to GAMBLING AFFILIATION all items necessary to the correct operation of its account, in particular its shall provide the visual advertising as well as its exact address and contact information and maintaining that information up to date.

    The advertiser is committed to not communicate with an unspecified editor in order to divert him from the GAMBLING AFFILIATION platform. Any proven attempt to exclude our platform will be the subject of a boycott on the Internet network of advertising controls.

    The advertiser is committed to not remove the "tag" which makes it possible for GAMBLING AFFILIATION to follow the actions surrounding the advertising campaign contracted between both parties, under penalty of the following sanction: The campaign would then be paid with the CPC on the basis of 0,15 euro of the CPC, in proportion to time passed since the last sale or last lead. If GAMBLING AFFILIATION carries out a control of tag generating a false sale, GAMBLING AFFILIATION will be authorized to refund itself up to the committed sum.

    The advertiser guarantees being in conformity with the law, and to have the rights, on information and visual which it uses via the platform.
      5 - Rights of use
    With the present terms and conditions, the advertiser gives full rights to GAMBLING AFFILIATION in the use of the text elements or graphs that will be provided to him.
      6 - Payments and billings
     The invoices are based on the statistics of the GAMBLING AFFILIATION platform. The statistics published by the GAMBLING AFFILIATION platform will be the only reference for the calculation of the cost of the campaigns of the advertiser.

    The advertiser is committed to pay to GAMBLING AFFILIATION the amount of the flow of its account, plus all taxes. The advertiser accepts that all the transactions prone to remuneration for the editor and forwarded on the GAMBLING AFFILIATION platform, are invoiced to him and added to its account.

    The flow of the account of the advertiser is carried out when one of the following actions: CPM, CPC, CPA, Revenue Share takes place on the platform.

    If the total amount of the credit remaining on the advertiser’s account is lower or equal to the totality of its expenditure, the advertiser accepts that its advertising campaigns are temporarily interrupted until a new money deposit is made on its account.

    The advertiser can pay his invoices by cheques, transfers or credit card. If for some reason, the payments are not made, the advertiser accepts that GAMBLING AFFILIATION can interrupt or close its account, as well as the advertising campaigns present on this one.

    The advertiser should inform GAMBLING AFFILIATION in writing of any dispute concerning the amount of an invoice within 90 day.
      7 - Commissions
    The advertiser accepts that GAMBLING AFFILIATION takes a commission of 40% calculated on the basis of remuneration of the editors and added to this one.
      8 - Clause of confidentiality
    LThe two parties will not reveal any information to a third party on the execution of this contract.

    This also includes not revealing any statistical or technical data of one the parts.
      9 - Cancellation
     This contract takes effect at the day of its acceptance and will expire after the cancellation of this one by the two parts, subject to the respect of these clauses. The present contract can be terminated upon written request, sent by registered mail.

    Remaining sums on the account of the advertiser, after deduction of an amount of

    1. 10% for account closing expenses if request is made within 90 days
    2. 30% for account closing expenses if request is made within 60 days
    3. 60% for account closing expenses if request is made within 30 days
    4. 100% for account closing expenses if request is made within less than 7 days

    will be refunded within 60 days after reception of the written request.
      10 - Miscellaneous:
     The campaign of the advertiser will be put online only when at least one visual advertising associated with this campaign, is installed on the GAMBLING AFFILIATION platform.

    GAMBLING AFFILIATION will not be held responsible of the fact that the sites validated by the advertiser does not comply with the advertisers expectations in publishing the visual.

    GAMBLING AFFILIATION will not be held responsible in case an advertisement would be present twice due a competitor platform.

    GAMBLING AFFILIATION reserves the right to interrupt a campaign, to close the account of the advertiser in the event of non respect by the advertiser of one of the terms of this contract.

    The advertiser certifies he has the necessary rights for the signature of this contract.
